These terms apply to consultancy services provided by Bavaria Consultants and to the use of this website. They are written to match how the website actually works: it is an information and enquiry site with no accounts, no online ordering and no payment processing.
1. Scope
These terms apply to advisory services, preliminary assessments and consultations provided by Bavaria Consultants (“we”) to clients (“you”). They apply to consumers (§ 13 BGB) and to entrepreneurs (§ 14 BGB) alike, unless a clause expressly refers to one group. Conflicting or supplementary terms of the client do not become part of a contract unless expressly agreed in writing.
2. Services we provide
We offer preliminary eligibility assessments, administrative guidance, document preparation support, process orientation and coordination in connection with German visa, residence, recognition, study, vocational training, family and business formation pathways.
Unless expressly agreed otherwise in writing, our contracts are service contracts (Dienstvertrag, §§ 611 ff. BGB). We owe the careful and professional performance of the advisory service, not a particular result.
3. No guarantee of an authority decision
Decisions on visas, appointments, residence permits and qualification recognition rest solely with the competent German authorities, including embassies and consulates, the Ausländerbehörde and the Bundesagentur für Arbeit. We have no influence over those decisions or over processing times, and we do not guarantee any outcome.
4. No legal or tax representation
Our services are administrative and organisational consulting. They are not legal advice within the meaning of the Rechtsdienstleistungsgesetz (RDG) and not tax advice within the meaning of the Steuerberatungsgesetz. Sending an enquiry through this website does not create any form of legal representation.
5. Certified translations
Certified translations are produced by independent, state-sworn translators (öffentlich bestellte und beeidigte Übersetzer) authorised in Germany. We act solely as an intermediary that processes, manages and delivers such requests on your behalf; the translator remains responsible for the translation itself.
6. Enquiry versus binding agreement
The presentation of services on this website is not a binding offer but an invitation to enquire. Completing a form and sending it by WhatsApp or email is an enquiry. A binding service agreement arises only when scope, deliverables and fees have been agreed between us in writing or in a comparable durable form, and we have confirmed it.
7. Fees
This website displays no prices. Fees are agreed individually for each engagement, together with the scope and the expected schedule, before any paid work begins. Any applicable German VAT is stated in that agreement.
8. Payment methods and how payment is arranged
This website does not accept or process payments. It has no checkout, no cart, no payment form and no payment provider integration, and clicking anything on this website never initiates a payment.

Payment methods are shown for information only. This website does not process online payments. The applicable method and payment instructions are confirmed separately after the service scope and fees are agreed.

9. Your duty to cooperate
- Provide information, documents and certificates accurately, completely and truthfully.
- Tell us promptly about changes to your personal, educational, financial or immigration situation.
- Check official requirements yourself where a decision depends on them.
We are not responsible for results that are incorrect, delayed or incomplete because the information supplied to us was inaccurate, misleading or missing.
10. Third-party services
Some steps involve independent third parties, for example sworn translators, blocked account providers, insurers, language test centres, universities and authorities. Their services are governed by their own terms and fees, and we are not responsible for their performance.
11. Cancellation and consumer withdrawal rights
Because no contract is concluded through this website, no withdrawal period starts by using it. Where a paid service agreement is later concluded with a consumer at a distance, statutory withdrawal rights may apply. In that case we will provide the applicable withdrawal information, including the period, how to exercise it and any circumstances in which it ends early, before that agreement becomes binding.
Statutory consumer rights are not affected by these terms. The exact withdrawal wording is to be settled by a qualified professional before launch.

12. Liability
We are liable without limitation for intent and gross negligence, and for damage arising from injury to life, body or health. In cases of slight negligence we are liable only for breach of an essential contractual obligation, and then limited to the typical, foreseeable damage. Liability for indirect damage, consequential financial loss, lost profit, or a visa application refused in the exercise of official discretion is excluded to the extent permitted by German law.

13. Intellectual property
Reports, evaluations, checklists and templates we create remain our intellectual property. You receive a non-exclusive, non-transferable right to use them for your own application. Reproduction, public distribution or commercial use requires our prior written consent.
14. Using this website
Guides and service descriptions on this website are general information, dated at the time of review. Requirements, amounts and authority procedures change; confirm current rules with the responsible authority before applying. The website creates no account, stores no enquiry and performs no automated eligibility decision.
15. Data protection
Personal data is processed in accordance with the GDPR and the German Federal Data Protection Act (BDSG). The details are set out in our Privacy Policy.

17. Governing law and jurisdiction
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers this choice applies only insofar as it does not remove the protection of mandatory provisions of the law of their habitual residence. Where the client is a merchant, a legal entity under public law, or has no general place of jurisdiction in Germany, the place of jurisdiction is our registered office in Germany.

18. Severability
If any provision of these terms is or becomes invalid or unenforceable, the remaining provisions stay in force. The invalid provision is replaced by a valid one that comes closest to its economic purpose.
